Cldh Open Letter To President Michel Aoun

رسالة مفتوحة موجّهة إلى فخامة رئيس الجمهورية اللبنانية الجنرال ميشال عون

بيروت، في 1 كانون الأوّل 2016 - إن المركز اللبناني لحقوق الإنسان يناشد الجنرال ميشال عون لاتخاذ الإجراءات الحاسمة في مسألة حقوق الإنسان كونها تقع على عاتق رئيس الجمهورية الجديد.
فيما يلي نص الرسالة المفتوحة:

فخامة رئيس الجمهورية اللبنانية،
إنّ المركز اللبناني لحقوق الإنسان CLDH يهنئكم على انتخابكم ويأمل منكم اتخاذ كافّة الإجراءات الممكنة لتعزيز فعاليّة تنفيذ الإعلان العالمي لحقوق الإنسان في لبنان الذي أقرّه الدستور اللبناني كماالتزامات لبنان الدولية.
يعمل المركز في لبنان منذ عام 2006، وهو يمثل استمرارية جمعية SOLIDA سوليدا (دعم اللبنانيين المعتقلين تعسّفيًا) الناشطة منذ عام 1996 على مسائل الاخفاء القسري، الاعتقال التعسفي، التعذيب والافلات من العقاب. كما يرتكز عمله على مشاكل التمييز والعنصرية وحقوق اللاجئين.

للأسف، إن حالة حقوق الانسان في لبنان مقلقة للغاية. بحيث في معظم الاحيان اصبح الافراد، وخاصة الاكثر تهميشاً ضحايا نظام خارج عن السيطرة ومخالف لحقوق الانسان الاساسية.

ما من مبرر لتعذيب اشخاص براءتهم مفترضة ؛ أن يقبع أشخاص في السجن بسبب محاكمة غير عادلة؛ أن يتم اضطهاد اللاجئين و/أو اعتقالهم لأجل غير مسمى من قبل الشرطة ومديرية الأمن العام على أساس وحيد ألا وهو أن الدولة اللبنانية لا تعترف بوضعهم؛ أن يتم توقيف وفصل الأطفال عن ذويهم لأنهم لا يحملون أوراقًا قانونية؛ أن يتم إهمال عائلات الأشخاص المخفيين بالكامل، ولا يحصلون على أي إجابة عن وضعهم، ويتم استغلال قضيتهم كواجهة من قبل بعض السياسيين الذين لا يقدمون أي مساعدة لهم؛ وأن يستعرض مخالفي حقوق الإنسان والمستعبدين والقتلة أحيانًا بدون اي ملاحقة في البلاد...

إن استخدام حجة مكافحة الإرهاب، وحجة حماية الأمن القومي أو حالات الطوارئ المختلفة لتبرير هذا الوضع القائم، مثل ما يفعل العديد من الأشخاص، هي إستراتيجية ديماغوجية وانتخابية مخزية و تجعل من لبنان دولة اللاقانون كما هو اليوم.

بصفتكم رئيسًا للجمهورية، لديكم السلطة في اتخاذ إجراءات معيّنة لها تأثيرًا فوريًا، و ليس لدينا أي شك أنه باستطاعتكم القيام بذلك:
الإعلان عن عفو رئاسي لكل شخصٍ تم توقيفه قبل عام 2005، منذ حقبة الاحتلال السوري، حيث كانت العدالة لا تتمتع بأي استقلالية. طلب دراسة وضع كل ملف لكل شخص يعاني من محاكمة غير عادلة بعد عام 2005، بغية إعلان عفو رئاسي لمجموعة الملفات المثيرة للشك، وذلك عندما يصبح من المستحيل معاينتها من جديد من قبل محكمة مستقلة. انشاء اللجنة الوطنية المستقلة لضحايا الاخفاء القسري ومفقودي الحرب وفقا للمرسوم المقدم من قبل الوزير شكيب قرطباوي والذي وافقت عليه الحكومة وطلبت بعض التعديلات الطفيفة عليه. إتخاذ مواقف علنية صريحة تتعلّق باللاجئين، وإدانة كل توقيف يتعلق بقانونية اقامة الشخص - بحيث يجب فقط توقيف الاشخاص الذين اتهموا رسميًا بجرمٍ أو جنحةٍ من قبل القضاء (وليس على أساس تصريحات ضابط أو موظف) . وضع كل اجنبي هرب من بلاده الى الاراضي اللبنانية تحت حماية الاجهزة الامنية اللبنانية وبالصورة الفورية - والسماح له بالحصول على حقوقه الإنسانية الأساسية. إتخاذ مواقف علنية وصارمة فيما يتعلّق بإعطاء العمال المهاجرين، ومن بينهم الذين يعملون في المنازل، نفس حقوق العمال اللبنانيين، وأنّ نظام ال"كفالة" هو تشريع للعبودية . إعتماد خطاب تهدئة، ضد العنصرية، وغير تمييزي في كل الظروف من أجل تهدئة الانقسامات الاجتماعية بين اللبنانيين أنفسهم من جهة وكذلك بين اللاجئين والمجتمع المحلي من جهة أخرى .
إنّ التوجه العالمي لانتهاك حقوق الإنسان يمكن أن يتم إحباطه، ونحن نود أنه، ولو لمرة واحدة، يصبح لبنان مثال احترام لالتزاماته الدولية . إن العديد من الإجراءات هي بين يديكم فخامة الرئيس.
بانتظار مواقفكم وإجراءاتكم، نرجو منكم أن تقبلوا، فخامة الرئيس، أطيب تحيّاتنا.

OPEN LETTER TO THE PRESIDENT OF THE REPUBLIC, GENERAL MICHEL AOUN
Beirut, November 30th, 2016 - The Lebanese Center for Human Rights (CLDH) calls on General Michel Aoun to take decisive actions and fulfill his responsibilities in all matters of human rights, as per inherent to his mandate as the new President of the Republic.

The text of the open letter is given below:

His Excellency General Michel Aoun, President of the Republic of Lebanon

The Lebanese Center for Human Rights congratulates you on your election and hopes that you take all possible measures to effectively promote the implementation of the Universal Declaration of Human Rights in Lebanon, endorsed by The Lebanese Constitution and the country’s international commitments.

CLDH has been established in Lebanon since 2006 and represents the extension of SOLIDA association (Support for Lebanese Detained Arbitrarily), which has been active since 1996 on issues of enforced disappearances, arbitrary detention, torture and impunity. Over time, CLDH has broadened its mandate to the fight against discrimination, racism and ensure the protection of refugees’ rights.

Unfortunately, Lebanon's picture today is very bleak, and every day, individuals – often among the most vulnerable – become victims of an out-of-control system that violates fundamental human rights.

There is no justification for torturing persons presumed innocent; having detainees languish in prison without access to a fair trial; arbitrarily holding in custody refugees by police and General Security officers for the sole reason of being a “refugee” because the State does not recognize such status; arresting children and separating them from their parents because they are undocumented; neglecting the families of the disappeared and not giving them any answer to their cases – but instead, using their cause as a showcase by politicians who do nothing to help them; not holding accountable human rights abusers, slavers, including criminals nor bringing them before justice.

Using the argument of the fight against terrorism, the promotion of national security or the existence of different emergencies to justify this situation, is a shameful demagogic and electoral response making Lebanon a State failing its Rule of Law, as per evidenced by the current situation in the country.

As the President of the Republic, you enjoy the power to act decisively on the following immediate steps, and we have no doubt you shall take into consideration the following:
- To grant a presidential pardon for any person arrested before 2005 from the time of the Syrian army occupation insofar as Justice at that time enjoyed no independence;
- To have a case-by-case review of the records of any person who has suffered an unfair trial after 2005 in order to grant presidential pardons for all doubtful cases when it is not possible to reconsider the case by an independent court;
- To immediately establish the National Commission on Enforced Disappearances in the form of a decree as presented to the Government by Minister Chakib Qortbaoui;
- To take firm public positions on refugees by condemning all arrests related solely to the legal status of persons. Only persons formally accused by the Justice (and not on the basis of an officer's statement) of a crime or offense shall be arrested;
- To order the immediate protection by the Lebanese State services of any foreigner having fled his/her country and present within Lebanon’s territory - and safeguarding their basic human rights;
- To take firm public positions on the fact that migrant workers, including domestic workers, should enjoy the same rights as Lebanese nationals and that the so-called "kafala" system is a legitimation of slavery
- To have a peaceful, anti-racist and non-discriminatory discussion in all circumstances aiming at effectively alleviating social cleavages between Lebanese people on the one hand, and between refugees and local communities on the other hand.

The global trend towards human rights violations can be thwarted and we want Lebanon, for once, to become an example of compliance with its international commitments. Yet now, most of those measures remain solely in your hands.

LETTRE OUVERTE AU PRESIDENT DE LA REPUBLIQUE, LE GENERAL MICHEL AOUN
Beyrouth, le 1er décembre 2016 – Le CLDH appelle le Général Michel Aoun à prendre les mesures décisives en matière de droits de l’Homme qui lui incombent en tant que nouveau Président de la République.
Le texte de la lettre ouverte figure ci-dessous :
Monsieur le Président de la République,
Le Centre Libanais des Droits Humains (CLDH) vous félicite pour votre élection et place en vous l’espoir de vous voir prendre toutes les mesures possibles visant à promouvoir effectivement l’application au Liban de la Déclaration Universelle des Droits de l’Homme entérinée par la Constitution du Liban et ses engagements internationaux.
Le CLDH est implanté au Liban depuis 2006 et représente une continuité de l’association SOLIDA (Soutien aux Libanais Détenus Arbitrairement) active depuis 1996 sur les questions de disparitions forcées, de détention arbitraire, de torture et d’impunité. Avec le temps, le CLDH s’est également concentré sur les problèmes de discrimination, de racisme et de droits des réfugiés.
Malheureusement, le tableau qu’offre aujourd’hui le Liban est très sombre, et chaque jour des individus, souvent parmi les plus vulnérables, deviennent les victimes d’un système hors de contrôle et violateur des droits humains fondamentaux.
Rien ne justifie que des personnes présumées innocentes soient torturées ; que des personnes croupissent en prison suite à des procès iniques ; que des réfugiés contre lesquels rien ne pèsent soient persécutés et/ou détenus indéfiniment par la police et la Sûreté Générale sur la seule base que l’Etat libanais ne reconnait pas leur statut ; que des enfants soient arrêtés et séparés de leurs parents parce qu’ils n’ont pas de papiers ; que les familles de disparus soient totalement négligées, ne reçoivent aucune réponse sur leurs cas, et que leur cause soit utilisée comme vitrine par des politiciens qui ne font rien pour les aider ; que des violateurs des droits de l’Homme, des esclavagistes, des tueurs parfois, paradent en toute impunité dans le pays…
Utiliser l’argument de la lutte contre le terrorisme, de la sécurité nationale ou de l’existence de différentes urgences pour justifier cette situation, comme certaines personnes le font, est une honteuse stratégie démagogique et électorale qui fait du Liban l’état de non-droit qu’il est aujourd’hui.
En tant que Président, vous avez le pouvoir de prendre certaines mesures à effet immédiat et nous espérons que vous prendrez acte des points suivants :
- Prononcer une grâce présidentielle pour toute personne arrêtée avant 2005 du temps de l’occupation de l’armée syrienne dans la mesure où la Justice ne bénéficiait à cette époque d’aucune indépendance;
- Faire étudier au cas par cas les dossiers de toute personne ayant subi un procès inéquitable après 2005, en vue de prononcer des grâces présidentielles dans l’ensemble des dossiers douteux quand il est impossible de refaire examiner le dossier par une cour indépendante
- Mettre en place immédiatement la commission nationale sur les disparitions forcées sous la forme d’un décret tel que présenté au gouvernement par le Ministre Chakib Qortbaoui ;
- Prendre des positions publiques fermes sur les réfugiés en condamnant toute arrestation liée au seul statut légal des personnes – seules les personnes formellement accusées par la Justice (et non sur la base des déclarations d’un officier) d’un crime ou d’un délit devraient être arrêtées ;
- Ordonner la mise sous protection immédiate par les services de l’Etat libanais de tout étranger ayant fui son pays et se trouvant sur le territoire libanais – lui donnant accès à ses droits humains fondamentaux ;
- Prendre des positions publiques fermes sur le fait que les travailleurs migrants, y compris les travailleuses domestiques, sont dotés des mêmes droits que les Libanais et que le système dit de la « kafala » est une légitimation de l’esclavage
- Avoir un discours pacificateur, anti raciste et non discriminatoire en toute circonstance visant à apaiser effectivement clivages sociaux entre les Libanais d’une part et entre les réfugiés et les communautés locales d’autre part
La tendance mondiale à la violation des droits humains peut être contrecarrée et nous voulons que, pour une fois, le Liban devienne un exemple de respect de ses engagements internationaux. Or, beaucoup de mesures sont entre vos seules mains.
