Resource Handbook On Natural Resources Ownership And Governance In Lebanon

I. ABOUT CSI

The Common Space Initiative for Shared Knowledge and Consensus Building is a Lebanese independent and inclusive initiative, registered under decree No. 1265. It facilitates structured dialogues among policy makers, intellectuals, experts, civil society actors, stakeholders, and individuals to create an environment that is conducive to national evolution. This is mainly achieved by enhancing public policy debates, building expertise and common knowledge resources on key issues, and collaborating among the concerned national parties.

II. PROJECT’S DESCRIPTION

The Common Space Initiative is commissioning a resource handbook on natural resources ownership and goovernance in Lebanon. This study is part of the «Oil for Development» project which focuses on building a Partnership for oil for the Common Good in Lebanon».

The project, which is conducted in cooperation with the Norwegian People’s Aid (NPA) and funded by the Norwegian Development Agency (NORAD), strives to strengthen the role, knowledge and capacities of local authorities in the matter and to build common understanding on key national issues among national and local policy-makers, stakeholders and experts in Lebanon.

The objective of the project is to better integrate local ownership, participation and local content in the Petroleum sector in Lebanon. This is achieved through increasing knowledge and capacity of local authorities on this subject, facilitating policy dialogues among all concerned stakeholders for the development of related frameworks and policies, and integrating the latter into national frameworks and strategies.

III. AIM OF THE RESOURCE HANDBOOK

The need for a resource handbook on natural resources governance stems out of the need to build a common understanding between all stakeholders on the importance of shared ownership in the governance of natural resources in Lebanon and more specifically in the oil and gas sector.

The resource handbook aims at offering local authorities (municipalities and unions of municipalities in Lebanon) a guide on natural resources governance in Lebanon. The guide shall tackle both the theoratical and practical realities and requirements when it comes to the ownership and local governance of natural resources in lebanon; it pays a special attention to the role of municipalities and unions of municipalities in Lebanon.

The consultant will be provided by CSI with a legal and field case studies on natural resources. These shall be the starting point of his/her work. Consequently, the consultant will be putting together a handbook on the governance of natural resources in Lebanon, highlighting the rights and duties of the different authorities in Lebanon, in addition to offering case studies of local goverance from other States and at the end suggest a policy framework to strenghten Lebanese local authrities role in the governance of natural resources.

The handbook should offer a comprehensive overview of natural resources governance covering the legal framework in the matter and the practical challenges and realities.

IV. SCOPE OF THE RESOURCE HANDBOOK

The consultant is required to achieve the following main tasks:

1. Develop a pragmatic methodology, an outline of which is to be attached to the cover letter. It should be in line with the contract’s period of 2 months. The methodology should mention the objectives behind the handbook and shall specify the resources used in preparing it (desktop review, meetings, and any other data collection method).

2. Review the legal study and three field case studies that will be provided by CSI and accordingly assess and analyze the different authorities’ roles and prerogatives when it comes to governing and conserving the natural resources in Lebanon with a focus on to local authorities’ role in the matter (i.e. municipalities and unions of municipalities). The said chapter should build on the provided studies but should not be limited to them; the consultant is requested to exert efforts to offer a comprehensive guide to local stakeholders on all prerogatives that local authorities can use to properly manage and conserve natural resources.

3. Review the international and regional treaties Lebanon is a signatory of and conclude accordingly the resulting obligations that the Lebanese State is supposed to conform with.

4. Present some case studies of regional or international best practices of local governance of natural resources.

5. Suggest a policy framework on the way forward to strengthen the involvement of municipalities and unions of municipalities in Lebanon in the governance of natural resources. This will be based on the following: 1) the legal and field case studies that reflects the theoretical and practical realities; and 2) the outcomes of the mapping of international and regional practices in the matter which reflect the best practices.

6. The consultant is required to share with CSI, two weeks starting from the signature of the agreement, a comparative table on the governance of natural resources in Lebanon; it should highlight local authorities’ role in each case/resource (or lack of role) and propose recommendations to strengthen or activate this role. This table is only a preliminary one and will help local authorities to have a general idea of their role and responsibilities in the matter.

V. OUTPUTS AND DELIVERABLES

A detailed methodology – including time line - shall be presented by the consultant to CSI and approved by the Head of Research at CSI The consultant shall share with CSI a preliminary comparative table as above-mentioned in a maximum period of TWO weeks from the contract’s signature. The consultant shall incorporate any feedback and undertake necessary revision of the draft report according to CSI written feed-back. Consultant shall submit final version of the handbook to CSI at the exact timeframe agreed upon. The final payment to the consultant will be processed after the final approval of the Final Report by CSI. Language of the study can be in Arabic or English.

VI. EDUCATION

University degree in Law, Social Sciences, Political Sciences, Public Administration, Economics, Documentation or related fields.

VII. WORK EXPERIENCE

At least 10 years of research experience in Law, Political Science, Public Administration or related fields with a focus on the governance of petroleum sector. Experience in drafting handbooks is a plus.
